– Represented a National Bank that foreclosed on property
contaminated by an adjacent dry cleaners.
Our RCRA Citizen’s Suit in federal court achieved a Order to clean up
Bank’s property, and reimburse all of its attorney’s fees. Forest Park Nat’l Bank v. Ditchfield, No. 10 C 3166 (N.D. Ill.
2012);

– Represented a Clinic developing a new office.
Environmental Engineering Firm’s Phase 2 study failed to find contaminationfrom
old underground storage tanks (USTs).
Our state court suit for negligence, etc., achieved an Order requiring
Firm’s reimbursement of Clinic’s costs.  Basran v. Gabriel Envl., No. 09-L-3471 (Cir.Ct.Cook

– Represented a local government Park District on the
successful redevelopment of an old golf course into a soccer and soft ball complex
overcoming NIMBY neighbors claiming environmental hazards from pesticide
residues;

– Represented a private golf course that discharged pond
sediment into a wooded area, leading to its unintended migration into a wetland,
against overlapping enforcement claims from local, state and federal wetlands regulators,
achieved favorable settlement;  People v. Knollwood Club, No. 12-CH-5318
(Cir.Ct.Lake Co., IL, 2012)

– Represented an Asbestos abatement contractor addressing
state Health Department regulations; IL

– Represented a family business facing an Clean Water Act
(CWA) administrative civil penalty complaint from USEPA; In the Matter Of: Misch Excavating, No. CWA-05-2011-0003 (USEPA,
2011)

– Ongoing representation of a potentially responsible
parties (PRP) group at the Macon-Dockery CERCLA (Superfund) National Priorities
List (NPL) Site – represented group in implementing cleanup under EPA Order,
then filed federal court CERCLA contribution litigation against multiple
defendants and successfully recovered $2.4 Million in costs; Crown Cork & Seal Co., v. CBS Corp.,
1:99cv00869 (M.D.N.C. 2002)

– Represented an environmental citizens group, the Alliance
for the Great Lakes, in their efforts to petitioning government agencies for
stronger invasive species regulations;
